The term “construction defect” broadly refers to defects in the design, materials, or workmanship that can affect mechanical systems, building components and structural integrity.

Generally, it is the architect or engineer that is responsible for flaws or defects in the design of a construction project. If the design was correct but the build was done incorrectly, it may be the contractor or builder that is liable. 

Building contracts usually contain a “defect liability period” that is usually between 12 to 24 months from completion.

The “defect liability period” from completion of a project typically runs for one year, or 12 months, and the developer is responsible for any defects that occur during that period or are uncovered in that time. 

A “maintenance period” is contractually agreed upon period of time that a contractor is legally obligated to remedy any defects in materials and workmanship, running from the completion of the construction project.
